READ BEFORE BOOKING

These Terms & Conditions apply to all bookings made for the Functional Fitness League (FFL) and the Hyrox YoungStars programme at PerformHQ. A full refund is available if you cancel within 14 days of booking and the programme starts more than 28 days away. Outside that window, a credit note or transfer applies depending on timing. Please see Section 4 for the full cancellation policy. Once a programme has commenced, no refund, credit note, or transfer is available under any circumstances. By completing a booking you confirm you have read, understood, and agreed to these terms in full.

1. PARTIES AND DEFINITIONS

In these Terms & Conditions the following definitions apply:

"PerformHQ", "we", "us", "our" means Northern Fitness Limited, Company No. 14728445, registered at Unit 56, Colne Valley Business Park, HD7 5QG.

"You", "booker" means the adult completing the booking and accepting these terms, whether on their own behalf or on behalf of a participant.

"Participant" means the individual registered to attend the programme, whether an adult FFL athlete or a junior YoungStars participant.

"FFL" means the Functional Fitness League, a structured 10-week team-based competitive fitness league hosted at PerformHQ.

"YoungStars" means the Hyrox YoungStars programme at PerformHQ, a structured 6-week junior race preparation block culminating in a Performance Day.

"Programme" means either FFL or YoungStars, as applicable to the booking in question.

"Season" means one complete 10-week FFL league cycle, including the finals series.

"Block" means one complete 6-week YoungStars cycle, including Performance Day.

"Start Date" means the date of the first competitive session of the relevant Season or Block as published at the time of booking.

"Booking Date" means the date on which full payment is received and a booking confirmation is issued by PerformHQ.

"Transfer" means the reassignment of a confirmed place to an eligible alternative participant prior to the programme commencing.

2. BOOKING AND PAYMENT

2.1 Confirmation

A booking is confirmed only upon receipt of full payment. No place is held, reserved, or guaranteed until cleared payment has been received. A booking confirmation will be issued by email to the address provided at the time of booking.

2.2 Pricing

FFL: The fee is as stated at the time of booking, covering four registered athletes for the full 10-week season and finals series.

YoungStars: The fee is as stated at the time of booking, covering all six weekly race preparation sessions and Performance Day within a single block.

The programme fee is inclusive of all sessions as specified. Fees are not divisible by individual session. PerformHQ reserves the right to amend fees between seasons or blocks. The fee applicable to any booking is the fee displayed at the time that booking is confirmed.

2.3 Payment

Full payment is due at the point of booking. We do not operate payment plans, deferred payment, or pay-on-the-day arrangements. Payment is processed securely via Stripe or an equivalent payment processor integrated into our booking platform. By proceeding with payment, you agree to the relevant payment processor's terms and privacy policy.

2.4 FFL Team Registration

An FFL team must comprise exactly four registered athletes at the time of booking. The team captain is the primary point of contact and is responsible for ensuring all team members are aware of and agree to these Terms & Conditions. All four athletes must complete the required registration documentation before attending their first session.

2.5 YoungStars Age Eligibility

YoungStars participants must fall within the age band of their registered group at the Start Date of the block. PerformHQ operates three age groups: Under 10s, Under 12s, and Under 14s. If a participant does not meet the age criteria for their registered group at the Start Date, PerformHQ reserves the right to transfer them to the appropriate group (subject to availability) or, where no suitable group exists, to cancel the booking and issue a credit note under Section 5.4.

3. PROGRAMME DELIVERY

3.1 Schedule

The schedule for each Season or Block is fixed and published at the time of booking. PerformHQ will not adjust the schedule to accommodate individual absences.

3.2 YoungStars Attendance Requirement

A minimum attendance of four out of six race preparation sessions is required for a YoungStars participant to be eligible for Performance Day. This is a firm eligibility threshold. Where a participant does not meet this threshold, they will not be permitted to take part in Performance Day. No refund, credit, or transfer will be issued in this circumstance.

3.3 FFL Attendance

FFL teams are responsible for their own weekly attendance. A missed session scores zero points for that week. No backdated scores will be awarded. Teams must confirm participation for the following season at least three weeks before the end of the current season.

3.4 Cancellation by PerformHQ

Where PerformHQ cancels an individual session due to circumstances beyond our control, we will make every reasonable effort to reschedule within the Season or Block. Where rescheduling is not possible, the session will be forfeited without refund. Where PerformHQ cancels an entire Season or Block prior to its Start Date, a full credit note will be issued under Section 5.4. No cash refund will be issued in this circumstance.

3.5 Programme Amendments

PerformHQ reserves the right to make reasonable amendments to the programme format, session structure, coach allocation, and venue layout. Reasonable notice will be given of any material changes. Amendments do not give rise to a right of cancellation or refund except as set out in Section 5.

4. CANCELLATION, REFUNDS, AND COOLING OFF

4.1 Statutory Cooling Off Right

Where a booking is made online, you have a statutory right under the Consumer Contracts Regulations 2013 to cancel within 14 days of the Booking Date (the "Cooling Off Period"). However, by proceeding with a booking for a programme with a fixed Start Date, you acknowledge that the service is time-specific and that the Cooling Off Period is modified by the conditions in Section 4.2.

4.2 Cancellation Policy

The following policy applies to all cancellations, regardless of reason. Requests must be submitted in writing to info@performhq.co.uk.

Within 14 days of booking AND 28+ days before programme start:
Full refund to original payment method within 10 business days.

More than 14 days before programme start (outside the 14-day window):
Credit note equal to full amount paid, valid for 12 months.

14 days or less before programme start:
No refund. Transfer to an eligible participant permitted. No credit note.

After programme has commenced:
No refund. No transfer. No credit note. Booking is forfeited in full.

4.3 How the Refund Window Works

A full refund is only available where both conditions are met simultaneously: (a) the cancellation request is received within 14 days of the Booking Date, and (b) the Start Date of the programme is more than 28 days away at the time the request is received. Where either condition is not met, the refund is not available and the next applicable tier applies.

This structure reflects the fixed-capacity nature of both programmes. Each place taken removes a slot that cannot be offered to another participant. Where a cancellation request is received close to the Start Date, the operational and revenue impact is material and the refund right is correspondingly reduced.

4.4 No Exceptions

PerformHQ will not make exceptions to this policy on grounds of illness, injury, medical advice, work commitments, school scheduling, holidays, or personal circumstance. We strongly recommend considering the participant's diary in full before booking. If there is uncertainty about whether a commitment can be met, we recommend waiting for a subsequent Season or Block.

4.5 Refund Processing

Where a full refund is approved under Section 4.2, the refund will be issued to the original payment method within 10 business days of the confirmed cancellation.

5. CREDIT NOTES AND TRANSFERS

5.1 Credit Notes

A credit note will be issued where a cancellation falls within the second tier of the policy in Section 4.2, or where PerformHQ cancels an entire Season or Block prior to its Start Date. Credit notes are valid for 12 months from the date of issue and may be applied against any future PerformHQ programme booking. Credit notes are non-transferable between bookers and have no cash value.

5.2 Transfer: When Permitted

A transfer of a confirmed place to an alternative participant is permitted only where the cancellation request is received before the programme Start Date and falls within the third tier of the cancellation policy (14 days or less before Start Date, outside the refund and credit note window). Transfers are not permitted once a programme has commenced under any circumstances.

IMPORTANT: Once the first session of a Season or Block has taken place, the booking is locked. No transfer, credit note, or refund will be issued regardless of the circumstances. This applies to FFL seasons and YoungStars blocks without exception.

5.3 Transfer Eligibility: Incoming Participant

The incoming participant (the "transferee") must:

- Be eligible for the programme or age group into which they are transferring at the date the transfer takes effect.
- Not already be registered in the same Season or Block.
- Have completed all required registration documentation (including registration form, health declaration, waiver, and where applicable photo and video consent form) before attending any session.
- For FFL: be confirmed as a registered team member, not a sub for a team already at full complement.

5.4 Transfer Process

To request a transfer, you must notify PerformHQ in writing at info@performhq.co.uk, providing: the full name of the original participant; the full name and date of birth of the proposed transferee; and contact details for the incoming party. A transfer is not valid until confirmed in writing by PerformHQ. PerformHQ reserves the right to decline a transfer where the incoming participant does not meet eligibility requirements.

5.5 Transfer Deadline

Transfer requests must be received and confirmed no later than 48 hours before the next scheduled session. Requests received inside this window will not be processed in time for that session, and the session will be forfeited by the original participant.

5.6 YoungStars Performance Day Eligibility on Transfer

An incoming YoungStars transferee's Performance Day eligibility is assessed from the date they join the block. The minimum attendance threshold of four sessions applies to the incoming participant from the point of confirmed transfer. Where the remaining sessions in the block are insufficient to meet this threshold, the transferee will not be eligible for Performance Day. No refund or credit is issued in this circumstance.

5.7 No Financial Arrangements

PerformHQ does not facilitate any financial arrangement between the original booker and the incoming participant. Any such arrangement is entirely a matter between those parties. PerformHQ's obligations are discharged in full upon confirmation of the transfer.

6. REGISTRATION, CONSENT, AND SAFEGUARDING

6.1 Required Documentation

All participants must complete the following documentation before attending any session. No participant will be admitted to any session until all required documents have been received and acknowledged by PerformHQ:

- Registration and participation consent form.
- Health declaration and waiver, confirming the participant is fit, healthy, and able to participate.
- Emergency contact details.

YoungStars participants additionally require:

- A parent or guardian to complete all of the above on the child's behalf.
- Photo and video consent form, completed at registration (not on the day).

6.2 Health and Fitness

By completing a booking, the booker warrants that the participant is in good health and physically able to participate. Where a participant's health status changes after booking, PerformHQ must be notified in writing before the participant attends their next session. PerformHQ reserves the right to exclude a participant from any session where there is reasonable concern about their ability to participate safely. No refund or credit is issued in such circumstances.

6.3 Safeguarding: YoungStars

PerformHQ operates under a formal safeguarding policy covering all junior programmes. The Designated Safeguarding Lead is the programme operator. A copy of the safeguarding policy is available on request. By registering a child for YoungStars, the parent or guardian consents to the child being subject to PerformHQ's safeguarding procedures throughout participation.

6.4 Collection: YoungStars

A collection register is in operation at every YoungStars session. No participant will leave the premises unaccompanied unless PerformHQ has received prior written authorisation from the parent or guardian identifying the person authorised to collect.

7. BEHAVIOUR AND EXCLUSION

All participants, team members, parents, and guardians are expected to conduct themselves with respect toward coaches, other participants, and PerformHQ staff. PerformHQ reserves the right to exclude any participant from a session or from the programme entirely where behaviour is deemed disruptive, unsafe, abusive, or contrary to the standards of the programme. Where a participant is excluded during a programme, no refund, credit note, or transfer will be issued for any remaining sessions.

8. JUDGING AND SCORING

FFL sessions are judged by PerformHQ staff. Each judge's decision is final. Movement standards are published in the weekly briefing and apply to all participants without exception. YoungStars sessions are overseen by a qualified standards coach whose decision on movement standards on Performance Day is final. Participants are taught all applicable standards during race preparation sessions prior to Performance Day.

9. LIABILITY

9.1 Participation Risk

Participation in any physical activity carries inherent risk of injury. By booking, the booker acknowledges that the participant takes part at their own risk. PerformHQ carries appropriate public liability insurance. Nothing in these Terms & Conditions excludes or limits liability for death or personal injury caused by our negligence, or for any other liability that cannot lawfully be excluded.

9.2 Personal Property

PerformHQ accepts no responsibility for the loss, theft, or damage of personal property brought onto the premises.

9.3 Force Majeure

PerformHQ shall not be liable for any failure to deliver the programme arising from circumstances beyond our reasonable control, including facility closure, adverse weather, utility failure, government restriction, or public health emergency. In such circumstances, a credit note will be issued as set out in Section 5.1.

10. PHOTOGRAPHY, VIDEO, AND RESULTS

10.1 Content Capture

Photography and video filming may take place at any PerformHQ session or event, including FFL league nights, YoungStars weekly preparation sessions, and Performance Days. This is subject to prior written consent given at the time of registration.

10.2 Withdrawal of Consent

Consent for photo and video use may be withdrawn at any time by notifying PerformHQ in writing. Withdrawal prevents future use of the participant's likeness in new content. Content already published in good faith prior to receipt of a withdrawal request cannot be retroactively removed.

10.3 Results: FFL

FFL leaderboard standings and weekly results are published in-venue and online as part of the structured league format. By entering FFL, participants consent to their team name and scores being published in league standings.

10.4 Results: YoungStars

Individual YoungStars Performance Day finish times are shared privately with the participant and parent or guardian only. Results are not published publicly or displayed on a leaderboard at the point of launch. This policy will be reviewed as the programme community develops.

11. DATA PROTECTION

Personal data collected in connection with your booking is processed by Northern Fitness Limited in accordance with the PerformHQ Privacy Policy, available at performhq.co.uk/privacy-policy. Data is processed under the UK General Data Protection Regulation and the Data Protection Act 2018. For YoungStars bookings, data relating to the child participant is processed on the basis of explicit consent provided by the parent or guardian at registration and is not used for marketing purposes.

12. AMENDMENTS TO THESE TERMS

PerformHQ reserves the right to update these Terms & Conditions. The version in force at the time of booking applies to that booking. Material changes will be communicated before they take effect and will not apply retrospectively to confirmed bookings. The current version is always published at performhq.co.uk.

13. GOVERNING LAW

These Terms & Conditions are governed by and construed in accordance with the law of England and Wales. Any dispute arising from or in connection with a booking shall be subject to the exclusive jurisdiction of the courts of England and Wales.
